Fictitious Business Name Statement Publication Requirements

The California Business and Professions Code requires that Fictitious Business Name Statements be published as follows:

• Publication must begin within 45 days of the date of filing the Statement. (B&P 17917(a)) 
• If you are renewing with no changes and within 40 days of expiration of previous statement, it does not need to be published. (B&P 17917(c)) 
• Statements must be published once a week, for 4 consecutive weeks in a newspaper of general circulation in the county where the fictitious business name was filed. 
• An affidavit of publication must be filed with the Business License unit within 45 days of completion of the publication (the affidavit is normally sent to our office by the newspaper - you may want to confirm that the paper you choose provides this service.) (B&P 17917(d)) 
• Statements of Abandonment must be published in the same manner as above. 
• Statements of Withdrawal from Partnerships must be published in the same manner as above unless a notice of the dissolution of the partnership has been published pursuant to Section 15035.5 of the Corporations Code. 
• If registrant has no place of business in this State, the notice must be published in a newspaper of general circulation in Sacramento County.
